The EB-5 visa in 2026 remains the only investment route to a US green card — and this year it carries a real deadline: investors who file by 30 September 2026 are grandfathered under the current program authorization even if Congress later lets it lapse. Add the noise around the new “$1M Gold Card,” and 2026 is the year EB-5 decisions reward people who read the actual rules. Verified 28 July 2026.

EB-5 in one paragraph (verified 28 July 2026): Invest $800,000 in a Targeted Employment Area (rural, high-unemployment or infrastructure) or $1,050,000 elsewhere, in a project creating 10 US jobs — typically via a licensed regional center. The Reform and Integrity Act authorizes the regional-center program through 30 September 2027, with filings made by 30 September 2026 grandfathered (processed even if authorization lapses). Rural set-aside petitions are being prioritized — many processed in roughly 5-12 months, versus ~18-33 months for standard urban filings. EB-5 leads to a conditional green card, then permanent residence, with citizenship possible after five years as a permanent resident.

What the Gold Card is — and isn’t

Executive Order 14351 (September 2025) created the “Gold Card“: a $1,000,000 individual / $2,000,000 corporate-sponsored gift route to expedited immigrant visas, operational since December 2025 via an official portal with a $15,000 non-refundable fee. Three things to hold onto: it is a donation, not an investment (compare that honestly on our calculator logic — it’s all sunk cost); its legality is contested, since green-card categories are set by Congress and legal challenges are expected; and EB-5 has not been abolished. A rumoured “$5M Platinum Card” requires legislation and is not law. For most investors the practical 2026 question is unchanged: a rural EB-5 filing before the September deadline.

Where EB-5 files fail

Source-of-funds documentation is the most demanding of any program we cover — every dollar traced, lawfully earned, and papered. (Crypto-sourced wealth is workable with meticulous records: our SOF guide applies with extra force here.) The second failure mode is project risk: your green card depends on the project actually creating the jobs, and your capital on the project succeeding. Independent diligence on the regional center’s track record matters more than any marketing brochure.

FAQ

Is EB-5 being replaced by the Gold Card?

No. EB-5 operates under its congressional authorization; the Gold Card is a separate, legally contested executive creation. Treat claims of EB-5’s death as marketing.

Why do people talk about rural projects so much?

Rural set-aside petitions get priority processing and reserved visa numbers — currently the fastest realistic route to the green card.

Is the $800,000 refundable?

It’s an at-risk investment, typically returned (if the project succeeds) after a multi-year term — it is not a fee, but it is also not guaranteed.
